End of Tenancy Council Tax Question

Has anyone come across this end of tenancy Council Tax situation as I have for a property tenancy which recently ended?

The tenants left on the end day of a 6 month assured shorthold tenancy. They were responsible for Council Tax and received the demands and paid the Council direct and contacted the Council to end?their liability as they obviously should. As Agent for the Landlord?I then received a Council Tax demand in the Landlords name.

This demand started 31st July the day the tenancy ended ? due to circumstances the key was actually returned by the tenant to my home address at 11.50pm on 31st July. I contacted the Council to state that 31st July was the end of the tenancy and the Tenants responsibility but they have advised that Section 2(1) and 2(2) give the Landlord the responsibility.

Looking this up I see that Section 2(1) says that Council Tax is determined on a daily basis and Section 2(2) says that it is assumed that any state of affairs subsisting at the end of the day has subsisted throughout the day ? I assume that it is the latter point they are applying to say the Landlord is responsible for 31st July.

My interpretation is that the tenancy agreement gives the tenants the responsibility for paying Council Tax for the whole period ? i.e.?from 1st February to 31st July inclusive or does the LGFA1992 take preference. The difference in actual monetary sums is little but I wondered relevant the principal of the matter.

Any comments/feedback would be appreciated.

What Is Colorectal Cancer (Colon and Rectal Cancer)?

Colorectal cancer is a term used to refer to cancer that starts in the colon or rectum. Colon and rectal cancers begin in the digestive system, also called the GI (gastrointestinal) system. This is where food is processed to create energy and rid the body of solid waste matter (stool).

After food is chewed and swallowed, it travels down to the stomach. There it is partly broken down and sent to the small intestine. The word ?small? refers to the width of the small intestine. The small intestine is really the longest part of the digestive system. It is about 20 feet long.

The small intestine continues breaking down the food and absorbs most of the nutrients. The small intestine joins the large intestine (also called the large bowel or colon), a muscular tube about five feet long. The first part of the colon absorbs water and nutrients from the food and also serves as a storage place for waste matter. The waste matter moves from the colon into the rectum, the last 6 inches of the digestive system. From there the waste passes out of the body through the opening called the anus.

The colon has 4 sections, as shown in the picture above. Cancer can start in any of the 4 sections or in the rectum. The wall of each of these sections (and rectum) has several layers of tissues. Cancer starts in the inner layer and can grow through some or all of the other layers. Knowing a little about these layers is helpful because the stage (extent of spread) of a cancer depends to a great degree on which of these layers it affects.

Cancer that starts in the different areas may cause different symptoms. But colon cancer and rectal cancer, together known as colorectal cancer, have many features in common. They will be discussed together in this document except for the section about treatment. There they will each be discussed separately.

In most cases, colorectal cancers develop slowly over a period of several years. We now know that most of these cancers begin as a polyp?a growth of tissue that starts in the lining and grows into the center of the colon or rectum. A type of polyp known as an adenoma can become cancerous. Removing the polyp early may prevent it from becoming cancer.

Over 95% of colon and rectal cancers are adenocarcinomas. These are cancers of the cells that line the inside of the colon and rectum. There are some other, more rare, types of tumors of the colon and rectum, but the facts given here refer only to adenocarcinomas.

Causes of colorectal cancer

There is no single cause of colorectal cancer, but some factors appear to increase the risk of developing it : -1. age ? particularly after 50.2. having polyps (small growths on the inner wall of the colon and rectum).3. family history of colorectal cancer ? especially if the relative (parent, sibling, child) developed colorectal cancer before the age of 45.4. having familial adenomatous polyposis (FAP) or hereditary nonpolyposis colon cancer (HNCC).5. inflammatory bowel disease (ulcerative colitis or Crohn?s disease).6. high-fat diet.7. alcohol consumption.8. smoking.9. physical inactivity.10. obesity.11. ethnic background ? people of Ashkenazi (Eastern European Jewish) descent. Researchers are also looking at how diet affects the risk of developing colorectal cancer. A diet high in vegetables and fruit is known to lower risk. A diet high in fiber and low in animal fats also seems to decrease risk, but more research is necessary to be sure. Some people develop colorectal cancer without any of these risk factors.

Symptoms of Colorectal Cancer (Colon and Rectal Cancer)

The following are the most common symptoms of colorectal cancer. However, each person may experience symptoms differently : -1. A change in bowel habits-such as diarrhea, constipation, or narrowing of the stool-that lasts for more than a few days.2. Bright red or very dark blood in the stool.3. Discomfort in the stomach area, such as frequent gas pain, cramps, and feelings of being full or bloated.4. Constant weakness and fatigue.5. Jaundice ? yellowing of the skin and eyes.6. weight loss for no known reason.

The diagnosis of Colorectal Cancer (Colon and Rectal Cancer)

The first step in the diagnosis of colorectal cancer may be a ?digital rectal exam.? In this test, which is often part of a routine physical exam, the doctor inserts a gloved finger into the rectum to feel for abnormal growths and may test your stool for occult blood. If colorectal cancer is suspected, you and your doctor have many tests to choose from to make sure the diagnosis is correct. Since there is a wide range of options, knowing the differences can help you make a smart decision.

Before these tests (except the fecal occult blood test), your colon must be completely empty. To clean out your bowels before the procedure, you may be instructed to have an enema or drink a large volume of a liquid laxative prescribed by your doctor. This preparation is very important in ensuring the accuracy of the test.

Fecal occult blood test : ? In this simple, initial screening test for colorectal cancer, a stool sample is applied to a special card that turns color if any blood is detected.

Barium enema : ? A narrow tube is inserted into the rectum to allow liquid barium (a white, chalky liquid) into the colon. A special x-ray is then taken, on which tumors or masses appear as dark shadows. The barium makes it easier to see the tumors. Before this test, you will be told to fast (not eat or drink) for several hours.

Flexible sigmoidoscopy : ? A thin, lighted tube inserted into the rectum allows the doctor to look into the rectum and first section of the colon (where half of all polyps are found).

Colonoscopy : ? The most accurate and thorough test for colorectal cancer (colon and rectal cancer). A long, thin, lighted tube inserted into the rectum allows the doctor to look into the entire colon, remove polyps, and take tissue for biopsy. Polyp removal will prevent cancer from developing. A mild sedative is usually given with this test.

Ultrasound : ? This noninvasive test uses images and sound waves to take a picture of the inside of the body. Unusual patterns in this image can indicate a mass or tumor. This test is used primarily to find cancer that has already spread to other organs.

Virtual colonoscopy (CT colonography) : ? This test creates a 3-dimensional reconstruction of the colon to reveal any abnormal masses. Images are taken seconds after the colon is inflated with carbon dioxide through a small rectal tube. Virtual colonoscopy is a fairly new technology, so it is not yet clear how accurate it is.

Treatment options for Colorectal Cancer in India : ? Treatment options for colorectal cancer depend on the stage of the tumor-that is, how far it has spread or how deeply it is affecting the intestinal wall and other tissues. Treatment is also determined by the patient?s age, medical history, overall health, and tolerance for specific medications and therapies. Standard options for colorectal cancer treatment in India include : -

1. Partial colectomy for colorectal cancer in India (also called partial bowel resection)-The tumor and normal tissue on either side of the diseased area in the colon are removed. The surgeon then reconnects the healthy colon. Sometimes the physician may have to create a temporary colostomy, or an opening for solid waste from the bowel to a special bag a patient wears outside the body, until the healthy tissue has healed. At times, the colostomy is permanent.2. Researchers say the alleged gunman in the Wisconsin Sikh temple was deeply involved in hate group subculture. The Army veteran, who was discharged for a drinking problem, played in two bands associated with racist skinheads. NBC's Pete Williams reports.

The gunman who allegedly attacked a Sikh temple in southern Wisconsin, killing six people and wounding four, was a ?white supremacist skinhead? and ?frustrated neo-Nazi? who led a white power punk and metal band, groups that track extremism said Monday.

Wade Michael Page, 40, was the founder of End Apathy, according to Mark Potok, a senior fellow at the?Southern Poverty Law Center. In a blog post about Page, Potok cited an April 2010 interview that the alleged gunman gave to the ?Uprise Direct? music website about the band?s work.

Page said his band, which formed in 2005, ?was based on trying to figure out what it would take to actually accomplish positive results in society and what is holding us back. A lot of what I realized at the time was that if we could figure out how to end people?s apathetic ways it would be the start towards moving forward. Of course after that it requires discipline, strict discipline to stay the course in our sick society.

?So, in a sense it was view of psychology and sociology. But I didn't want to just point the finger at what other people should do, but also I was willing to point out some of my faults on how I was holding myself back. And that is how I wrote the song ?Self Destruct,?? he said.

Mark Pitcavage, director of investigative research for the Anti-Defamation League, said?Page was a mem?ber of the Ham?mer?skins, "one of the oldest and largest hardcore racist skinhead groups," and iden?ti?fied him?self as a North?ern Ham?mer?skin, part of the group?s upper Mid?west branch.?

End Apa?thy had been a fea?tured band in recent years at many Hammerskin-organized white power music con?certs, such as the August 2010 ?Meet? & Greet BBQ & Bands? in North Car?olina, the Ham?mer?skins? St. Patty?s Day Show in March 2011 in Orlando, Fla., and Ham?mer?fest 2011 last Octo?ber in Orlando, Pitcavage noted in a blog post, in which he described Page as a "white supremacist skinhead."

?We had identified Page several years ago as someone who was prominent in the white-power music scene,? he told NBC News. He said Page also used a pseudonym, ?Jack Boot,? an apparent reference to the high military boots worn by members of dictatorial regimes such as Nazi Germany.

The white-power music scene is one of the main things that the Hammerskins do in the United States and is a ?fairly important part of the white supremacist subculture" in the country, said Pitcavage. Because of Page's role in that music scene, he had already become linked with the Hammerskins through his involvement in bands tied to the group and his performances at their events.

Page became a ?fully patched? member of the Hammerskins by late 2011 after going through an apprenticeship period. He had one of their tattoos on his right arm -- a sort of cogwheel with the numbers 838 inside it (838 is an alpha-numeric code that means ?hail crossed hammers,? a reference to their logo of two-crossed hammers that was taken from Pink Floyd?s ?The Wall?), Pitcavage said. The tattoo also had the?group?s colors of red, black and yellow.

A photo of Page also showed that he had a Celtic Cross tattoo with the number 14 in it, which is a ?major white supremacist symbol,? Pitcavage said.

The Hammerskins emerged in Texas in the mid-to-late 1980s and spread across the country. They are loosely organized, not hierarchical and tend to group themselves regionally.

?It has had a strong association with violence over the past several decades,? Pitcavage said, noting that it was not surprising that the alleged gunman ?was a white supremacist because white supremacist shooting sprees tend to be directed at minorities.?

Page said in the ?Uprise? interview that his music was a mix of '80s punk, metal and Oi!, a subgenre of punk.

?The topics vary from sociological issues, religion, and how the value of human life has been degraded by being submissive to tyranny and hypocrisy that we are subjugated to,? he said in the interview.

Page was a ?frustrated neo-Nazi who had been the leader of a racist white-power band,? wrote Potok, of the Southern Poverty Law Center. ?In 2000, the Southern Poverty Law Center has found that Page also attempted to purchase goods from the neo-Nazi National Alliance, then America's most important hate group.?

The FBI was ?looking at ties to white supremacist groups? in the case, said?Teresa Carlson, FBI special agent in charge in Milwaukee. They were also investigating the attack?as possible domestic terrorism, which she noted meant use of force or violence for social or political gain. The FBI did not have an active investigation on Page before Sunday.

Page, an Army veteran who served from 1992 to 1998 but was never deployed, said in the ?Uprise? interview that he was from Colorado and that in 2000 he ?wanted to basically start over.?

Since 2009, the United States has been in the middle of a ?huge resurgence? of right-wing extremism largely split into two spheres: an anti-government extremist one, such as the militia movement, and white supremacists, Pitcavage said. The number of militia groups has quintupled in the past three years and there have been many arrests of white supremacists over the same time for acts of violence, he said.

The election of a non-white president and the struggling economy were the triggers, Pitcavage said.

?It?s just a huge number of incidents from the extreme right since 2009. It?s the biggest resurgence of right-wing extremist activity since the mid-1990s and the Oklahoma City bombing (in 1995), and it?s causing problems all around the country,? he added.

On End Apathy's Myspace page, the group listed its location as Nashville, N.C., and said they had finished recording for an upcoming release on Label 56, which the ADL described as a Maryland-based company that distributes racist skinhead music, videos and merchandise. The last login for the page was dated Feb. 21, 2012.

Label 56 issued a statement Monday saying that all images and products related to the group had been removed from their website.

?We do not wish to profit from this tragedy financially or with publicity,? said the label. ?In closing please do not take what Wade did as honorable or respectable and please do not think we are all like that.?

Label 56 officials did not respond to an email and phone call seeking comment.
